Terms of Service

Welcome to JustPickedUp ("we," "us," "our," "Company," or "Service"). These Terms of Service ("Terms") govern your use of the JustPickedUp website and mobile app, including all content, features, and functionality. By accessing or using JustPickedUp, you agree to be bound by these Terms. If you do not agree to any part of these Terms, you may not use the Service.

JustPickedUp is operated by Pierre Roberge in Quebec, Canada. The Service is provided "as is" without warranty. Your use of the Service is at your own risk.

1. Account Creation and Responsibility

To use JustPickedUp, you must create an account by providing your email address and creating a username. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the confidentiality of your account credentials.
• Notify us immediately if you suspect unauthorized access to your account.
• Accept responsibility for all activity under your account.
• Be at least 13 years old to create an account (or older, as required by your jurisdiction).

You may not create accounts under false pretenses or impersonate another person. We reserve the right to suspend or terminate accounts that violate these terms.

2. Acceptable Use

When using JustPickedUp, you agree not to:

• Post illegal content, hate speech, harassment, or threats.
• Upload copyrighted material you don't own or have the right to use.
• Engage in spam, phishing, or fraudulent activity.
• Attempt to hack, disrupt, or damage the Service.
• Use the Service to promote illegal goods or services.
• Circumvent security measures or access systems without authorization.
• Scrape, crawl, or automatically access the Service except through official APIs (if provided).
• Use the Service to harass, bully, or defame others.

Violation of these rules may result in immediate account suspension or termination at our discretion.

3. Intellectual Property Rights

Your Content

You retain all rights to the photos, text, and car data ("Your Content") you upload to JustPickedUp. You own your car profile, your service history, and your photos. By uploading Your Content, you grant JustPickedUp a worldwide, royalty-free, non-exclusive license to:

• Display Your Content on your public profile (if you choose to publish).
• Store and backup Your Content for service continuity.
• Use Your Content for analytics and service improvement (in aggregated form).

You may delete Your Content at any time, and we will remove it from the Service within 30 days. Deleted content will no longer be publicly accessible.

JustPickedUp Content

The JustPickedUp website, app, logo, design, text, code, and functionality (excluding Your Content) are owned by JustPickedUp or its licensors. You may not copy, modify, distribute, or use these materials without permission. Limited personal, non-commercial use is permitted.

4. Subscriptions and Billing

Free Trial

New users receive a free 30-day trial to build and manage car profiles. During the trial, you have full access to all features. No credit card is required.

Subscription Plans

After your free trial expires, you may choose a paid subscription plan:

• Owner Plan ($8.99/mo or $79.99/yr): Publish and share 1 car profile publicly.
• Garage Plan ($14.99/mo or $129.99/yr): Publish 2–4 car profiles.
• Collector Plan ($24.99/mo or $199.99/yr): Publish 5–8 car profiles.

You can build unlimited car profiles with any plan; the subscription limits how many you can publish publicly. Without an active subscription, your profiles remain private and accessible only to you.

Billing and Renewal

• Subscriptions auto-renew at the end of your billing period (monthly or yearly).
• We will charge your payment method on file. You are responsible for keeping payment information current.
• If payment fails, we will attempt to retry. After repeated failures, your subscription may be suspended.
• You can cancel your subscription anytime in your account settings. Cancellation takes effect at the end of your current billing period.

Refunds

We do not offer refunds for partial months. If you cancel mid-month, you retain access until the end of your billing period. Your payment provider (e.g., Stripe) may have its own refund policies—contact them directly for disputes.

5. Termination

By You: You can delete your account anytime in your account settings. Upon deletion, your data will be removed from the Service within 30 days.

By Us: We may suspend or terminate your account immediately if you violate these Terms, engage in illegal activity, or pose a risk to the Service or other users. If we terminate your account for reasons unrelated to misuse, we will provide 30 days' notice and allow you to export your data.

Upon termination, your access to the Service ends. Except as required by law, we are not obligated to maintain Your Content after your account is deleted.

6. Disclaimers

AS-IS Service: JustPickedUp is provided "as is" without warranties of any kind. We make no guarantees about:

• Uninterrupted or error-free Service.
• Accuracy or completeness of VIN decoding or AI-parsed maintenance records.
• Data backup or recovery in case of loss.
• Specific results or outcomes from using the Service.

Third-Party Services: JustPickedUp integrates with third-party providers (Supabase, Stripe, Cloudflare, etc.). We are not responsible for their actions, outages, or failures. Their terms and privacy policies apply to your data shared with them.

AI Limitations: Claude AI processes your maintenance updates to extract structured data. This feature is provided as a convenience tool. AI may make errors or miss details. You are responsible for reviewing AI-generated summaries for accuracy. We do not guarantee AI output quality.

7. Limitation of Liability

To the fullest extent permitted by law, JustPickedUp shall not be liable for:

• Loss of data, income, or profits.
• Indirect, incidental, or consequential damages.
• Damages arising from unauthorized access or data breaches (except where negligence is proven).
• Third-party content or services.

Cap on Liability: Our total liability to you for any claims related to the Service shall not exceed the amount you paid JustPickedUp in the 12 months preceding the claim (or $100, whichever is greater).

8. Indemnification

You agree to defend, indemnify, and hold harmless JustPickedUp and its team from any claims, damages, or legal costs arising from:

• Your violation of these Terms.
• Your misuse of the Service.
• Your violation of applicable law.
• Claims that Your Content infringes third-party rights.

9. Governing Law and Jurisdiction

These Terms are governed by the laws of the Province of Quebec, Canada, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts of Quebec for any disputes. If you reside outside Canada and a claim arises, you may bring it in your local court, but we may also bring claims against you in Canada.

10. Modifications to These Terms

We may update these Terms at any time. We will notify you of significant changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of JustPickedUp after such changes constitutes your acceptance of the new Terms. If you disagree with updated Terms, you may delete your account.

11. Modifications to the Service

JustPickedUp reserves the right to modify or discontinue features, pricing, or the Service itself at any time, with or without notice. We are not liable for any losses resulting from these changes.

12. Miscellaneous

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and JustPickedUp.

Severability: If any provision of these Terms is found to be unenforceable, that provision will be removed and the remaining Terms will remain in effect.

Waiver: Our failure to enforce any right does not constitute a waiver of that right.

Assignment: You may not assign these Terms or your account. JustPickedUp may assign these Terms or transfer your account as part of a sale, merger, or acquisition.
